El Dorado resident sentenced after pleading guilty to drug, theft charges


By KELI JACOBI News-Times Staff An El Dorado man was sentenced to two years in the Community Correction Center after pleading guilty to drug and theft charges late Tuesday in Union County Circuit Court.
James Shaver, 23, pleaded guilty to one count of theft of property and one count of conspiracy to the delivery of a controlled substance (crack cocaine). He admitted that he and several co-defendants stole scrap metal on two separate occasions last November and collected over $700 after selling the scrap to a local dealer.
Shaver was arrested on separate drug charges following an undercover nar cotics buy in June at a local motel. He was originally charged with delivery of cocaine, possession of cocaine with in tent to deliver and possession of drug paraphernalia, but those charges were amended during plea discussions.
Shaver was ordered to pay restitution of $744 to Barker’s Steel and assessed $800 in court costs and attorney’s fees. He was also assessed $250 for a DNA sample and given a fi ve-year suspended imposition of sentence.
Judge Carol C. Anthony also accepted the guilty pleas of several other defendants Tuesday evening, including: • James Earl Johnston, 43, to seconddegree terroristic threatening and possession of a controlled substance (marijuana), second offense. A charge of drug paraphernalia possession was dropped during plea discussions. Johnston was given three years probation and fi ned $50. He was assessed court costs and attorney’s fees of $250. His driver’s license was suspended for six months.
• Herbert Gene Clark, 62, to misdemeanor theft charges, amended from felony theft charges. He was fi ned $150 and sentenced to county jail for one year. He was assessed court costs and attorney’s fees totaling $400.
• Danny Dunlap, 24, to possession of a controlled substance (marijuana) with intent to deliver and possession of drug paraphernalia. He was given a three-year suspended imposition of sentence and fi ned $300. He was assessed court costs and attorney’s fees totaling $400. His driver’s license was suspended for six months.
• Telly Denton to violation of the Arkansas Hot Check Law. He is to return to court for sentencing on Sept. 19.
• John D. Shirey, 31, to fl eeing. He was sentenced to one year in county jail and fi ned $100. He was assessed court costs and attorney’s fees totaling $400.
Shirey also pleaded true to two counts of violation of the terms of his probation. He was placed on probation in 2004 following guilty pleas to hot check violations and resisting arrest. He was given a fi ve year suspended imposition of sentence and fi ned $20. He was assessed additional court costs of $300.
• James C. Wilson, 26, to breaking or entering and theft of property. He also admitted to being a habitual offender. He was given a three-year suspended imposition of sentence and fi ned $450. He was sentenced to one year in the county jail and assessed court costs and attorney’s fees totaling $800.
• John Millage, 25, pleaded true to violation of terms of probation. His probation was extended three years and he was assessed court costs and attorney’s fees totaling $400. He was placed on probation in 2002 following his admission of guilt to breaking or entering charges.
• Gloria Moore, 39, pleaded true to violation of terms of probation. Her probation was extended three years and she was assessed court costs and attorney’s fees totaling $400. She was placed on probation in December 2004 following a guilty plea to fraudulent use of a credit card.
